Welcome to Bayheadgables. These Terms of Use govern your access to and use of our website and hardware wallet repair services. Please read these Terms carefully before using our services.

By accessing or using our website or services, you agree to be bound by these Terms of Use. If you do not agree to these Terms, please do not use our website or services.

1. Acceptance of Terms

By accessing or using the Bayheadgables website, mobile applications, or any services provided by Bayheadgables (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Bayheadgables regarding your use of the Services.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet all eligibility requirements. If you are using the Services on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind that entity to these Terms.

3. Service Description

3.1 Hardware Wallet Repair Services

Bayheadgables provides repair services for cryptocurrency hardware wallets. Our services include diagnostics, component repairs, screen replacements, button repairs, and other hardware-related issues. We do not provide services related to cryptocurrency recovery, private key extraction, or any service that would compromise the security model of hardware wallets.

3.2 Service Process

When you submit your hardware wallet for repair:

  1. You will receive a repair quote based on your description of the issue
  2. Upon acceptance of the quote, you will ship your device to us or drop it off at our location
  3. We will diagnose the issue and confirm the repair cost
  4. We will perform the repair upon your approval of the final cost
  5. We will test the functionality of the device (without accessing any cryptocurrency assets)
  6. We will return the repaired device to you via secure shipping or pickup

4. User Responsibilities

4.1 Backup and Security

You are solely responsible for:

  • Backing up your recovery phrase/seed words before sending your device for repair
  • Maintaining the security of your recovery phrase
  • Never sharing your recovery phrase, PIN, or private keys with anyone, including our staff

We strongly recommend you reset your device to factory settings before sending it for repair when possible. If your device is functional enough to perform this action, it helps protect your security.

4.2 Accurate Information

You agree to provide accurate, current, and complete information when submitting your repair request, creating an account, or communicating with us regarding your repair. Providing false or misleading information may result in delays or inability to complete your repair.

5. Repair Warranties

Bayheadgables provides limited warranties on our repair services as follows:

  • Basic Repair: 30-day warranty on repaired components
  • Standard Repair: 60-day warranty on repaired components
  • Premium Repair: 90-day warranty on repaired components

Our warranty covers only the specific components that were repaired or replaced as part of our service. The warranty does not cover:

  • Damage caused by user mishandling after repair
  • Water damage or physical damage occurring after repair
  • Issues unrelated to the original repair
  • Tampering with the device after repair
  • Firmware or software issues not related to hardware components

6. Payment and Fees

6.1 Repair Costs

Repair costs are based on the nature of the repair required. We provide:

  • An initial estimate based on your description
  • A final quote after diagnosing your device

You have the right to decline service if the final quote exceeds your initial estimate. In such cases, a diagnostic fee may still apply.

6.2 Payment Methods

We accept payment via credit/debit cards, bank transfers, and select cryptocurrencies. All payments must be completed before the repaired device is returned to you.

6.3 Abandoned Devices

If you do not pay for and retrieve your device within 90 days after being notified that your repair is complete, your device may be considered abandoned. We reserve the right to dispose of abandoned devices in accordance with applicable laws.

7. Shipping and Handling

For mail-in repairs:

  • You are responsible for shipping costs to send your device to us unless otherwise specified in a promotion
  • We recommend using tracked shipping methods with appropriate insurance
  • We are not responsible for devices lost or damaged during shipping to our facility
  • Return shipping costs are typically included in our repair quotes
  • We use secure, insured shipping methods for returning devices

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Bayheadgables or our content suppliers and is protected by United States and international copyright laws.

You may not reproduce, modify, distribute, or republish any materials from our website without our prior written consent. This includes using our content for any commercial purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Bayheadgables shall not be liable for:

  • Any loss of cryptocurrency assets during the repair process
  • Damages resulting from your failure to back up your recovery phrase
  • Consequential, incidental, indirect, or special damages arising from your use of our services
  • Damages exceeding the amount paid for the repair service
  • Delays in repair service due to parts availability or circumstances beyond our control
  • Data loss or corruption during the repair process

Our total liability for any claim arising from or related to these Terms or our Services shall not exceed the amount you paid for the specific repair service giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bayheadgables and our officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights, including privacy or intellectual property rights
  • Any claim that your content or information caused damage to a third party

11. Termination

We reserve the right to terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account or service relationship, you may simply discontinue using the Services or contact us to request account deletion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or your use of our Services shall be brought exclusively in the federal or state courts located in Cook County, Illinois, and you consent to the personal jurisdiction of such courts.

13. Dispute Resolution

Any dispute arising from or relating to these Terms or our Services shall first be attempted to be resolved through good faith negotiations. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation in accordance with the Commercial Mediation Rules of the American Arbitration Association.

If mediation is unsuccessful, the dispute may be resolved through arbitration or litigation as specified in the Governing Law section above.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and Bayheadgables regarding our Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.
